Terms and Conditions

Please review the terms and conditions for The Safe at Home Membership program.

This agreement is a maintenance agreement, not an insurance policy, extended warranty or service contract. This agreement is between the seller and the purchaser and provides for certain inspections and maintenance herein.

This Agreement shall have an initial term of one (1) year commencing on the Effective Date ("Initial Term"). Unless either party provides written notice of non-renewal to the other party at least thirty (30) days prior to the expiration of the then-current term (the "Renewal Notice Period"), this Agreement shall automatically renew for successive annual periods (each, a "Renewal Term") of one (1) year each, under the same terms and conditions in effect during the immediately preceding term, except for any adjustments to fees or terms expressly permitted herein and provided with prior notice as required by law. You may cancel this Agreement and prevent automatic renewal by delivering written notice of termination to Home Run Heating and Air Conditioning at office@homerunair.com during the Renewal Notice Period. Cancellation will be effective at the end of the then-current term. No partial refunds will be issued for the unused portion of the term. By signing below, you affirmatively consent to the automatic renewal of this Agreement as described above and acknowledge receipt of this disclosure in a clear and conspicuous manner. Home Run Heating and Air Conditioning will provide an annual renewal reminder notice via email at least 15-45 days before the end of each term, including the renewal frequency, amount, and cancellation instructions. Records of your consent will be maintained for at least three (3) years.

This agreement provides for specific inspections and maintenance only for the heating and/or cooling equipment listed on the front of this agreement. We will provide the following benefits to you during the term of this agreement with respect to the listed equipment: We will perform semi-annual inspections on your listed equipment each 6-month period during the term of this agreement. Performance inspections will include (to the extent applicable and to the extent the components of your listed equipment are accessible) those services indicated on the front of this agreement. You may contact us to schedule your performance inspections. Performance inspections will be scheduled to be completed during the term of this agreement during normal business hours. For other services, we will use reasonable efforts to provide you with priority service through preferential treatment in the scheduling of your call. You may contact us for emergency service 24 hours a day, seven days a week. Emergencies are situations that create substantial risk of injury to persons or substantial property damage. For any repairs we perform on the listed equipment during the term of this agreement, will be provide you with our flat rate pricing applicable to such repairs, when available. We will provide you with a ten percent (10%) discount off (up to $100 discount) our usual and customary repair rates or as indicated in our flat rate manuals (Safe at Home Membership pricing). Should any such repair performed by us on the listed equipment during the term of this agreement fail within 12 months of the date of the repair due to our workmanship, we will perform the repair again at no cost to you for our labor. This warranty does not constitute a warranty of any parts or include the cost of any replacement parts. A separate warranty from the manufacturer of these parts may apply to parts that were used to perform the repair or otherwise furnished to you.

This agreement will expire and may be transferred or canceled as follows: This agreement will expire upon the expiration date set forth on the front of this agreement. This agreement will expire prior to the expiration date set forth on this agreement at such time as you or any permitted transferee no longer owns the listed equipment. No service will be required to be rendered by Home Run Heating and Air Conditioning under this agreement if you have a past-due account. This agreement can be canceled by Home Run Heating and Air Conditioning for fraud, material misrepresentation, your failure to make any payment required under this agreement when due or your failure to pay for any services or goods rendered or provided by Home Run Heating and Air Conditioning to you, whether in connection with this agreement or otherwise. In addition to any right you may have under law or elsewhere in this agreement, you may cancel this agreement within the first three days following the effective date of this agreement. If no services have been performed under this agreement or if required by law, you will receive a full refund.

Membership is available to all residential residents of San Diego and South Riverside County. Annual tune-up must be scheduled during regular business hours and is subject to availability. For best performance, we recommend the A/C tune up in the Spring and the furnace tune up in the Fall. Home Run Heating and Air reserves the right to modify or discontinue the program with 30 days’ notice. Discounts cannot be combined with other offers or promotions. Membership is non-transferable and valid for one HVAC system per household. This agreement does not cover and we will not be responsible for: Any breakdown or failure of the equipment or any failure to detect any defect in or malfunction of the listed equipment. Any parts or labor for any required repairs, except that if you have us provide the required repairs on the listed equipment during the terms of this agreement, the repairs will be provided in accordance with the provisions of this agreement. Any consequential, secondary or incidental damages or any bodily injury or property damage, regardless of cause.
